In Real Estate Comm'n v. McLemore, the license of a real estate broker was revoked by the Real Estate Commission and a petition for certiorari seeking a trial de novo filed. The supreme court held that the petition before the circuit court was insufficient for the issuance of writ of certiorari at common law or under the statute for the reason that the petition did not contain a statement of the facts or circumstances, which show a probability of innocence, upon which the circuit judge might have exercised his discretion in the issuance 'of the writ.
